How ignoring mobile device security increases your risk

first_imgEnticed by the promise of increased performance and employee flexibility, financial institutions are rightfully beginning to allow employees to bring personally-owned devices into the workplace. Moving into the fully mobile workforce era, we see the trend continue to move into the hands of the consumer. While controlling the enterprise used to be a fairly simple endeavor, financial institutions are now faced with a never-ending onslaught of devices that are smaller, faster and more capable than even the computers sitting on the desktop. Without effective risk strategies, this poses a significant threat to any financial institution that allows Bring Your Own Devices (BYOD) into their environment.Recent Forrester Research studies show that three out of four professionals use personal devices to access corporate data, with 53 percent of all employees bringing some sort of personally-owned device to work each day. Combine that with the statistics that show over 70 million mobile devices are lost or stolen each year, with about 46 percent of devices in the workplace being completely unmanaged, it is clear that we have a very large problem.First, let’s fully understand the risks. Today’s typical smartphones are not just phones. They are cameras, voice recorders, scanners, calendars, clocks, navigation systems, gambling devices, portable movie theatres, bookstores, magazine racks, games, and computers. The major issue is that the company’s data is now being stored and transmitted using these devices that the employer does not control, which is sometimes in direct conflict with governmental regulations and recommendations that ask us to carefully protect the privacy and security of sensitive, personal and financial information.New software, known as Mobile Device Management (MDM) can assist with these risks, and amidst this extreme mobile era, should be considered a mandatory first step if you allow personally-owned devices to have access to your corporate data or network. But equally important, a comprehensive review of policies and procedures is needed to ensure that not only are employees required to behave correctly in respect to protecting this data, but also to protect the company from employee litigation. Many financial institutions are finding gaps in policies and procedures regarding appropriate use of technology because the rules were based on the functionality of devices that existed when the policies and procedures were initially drafted. Policies and procedures should no longer be specific to just the hardware being used, but also should address the broad range of activities for which these devices can be used.We have to keep in mind that not only do we have issues with keeping our corporate and clients’ data safe, but we also now have the added issue of these devices being used for both personal and work purposes. This opens financial institutions to risk not just from loss of company data, but also to litigation risk from employees who have expectations of privacy on a device that is owned by them. The U.S. courts have consistently held up employees’ rights when employers have attempted to gain access to an employee’s personal device. This has implications for record management regulations, privacy of employee data, overtime for employees using a dual-use device, and access to the employee’s device during litigation holds and investigations.In order to adequately mitigate the risks associated with BYOD programs, we of course first need to implement strong technical controls using MDM software. This software generally covers device restrictions, encryption, strong passwords and the ability to locate the device and remotely wipe the data from it. But we also need to move beyond simple technical controls and develop a full RiskManagement program around BYOD.
At a minimum, action items should include:Implement MDM software with strong technical controls.Develop employee agreements that cover not only the acceptable use of the device, but also reserve the right of the institution 
to access or wipe the device as needed.Implement operating procedures that ensure all devices are indeed covered and are being used appropriately.Develop and deliver mandatory employee training to teach employees how they should handle the loss or theft of the device

Bach rejects Society’s legal aid fee cut fears

first_imgLegal aid minister Lord Bach (pictured) has rejected Chancery Lane’s demand for an extension to the consultation period on proposed criminal legal aid cuts. He also dismissed the Law Society’s allegation that the August consultation paper Legal aid: funding reforms is ‘incoherent’ and ‘deeply flawed’. The paper proposes cutting fees to duty solicitors and reducing Crown court defence barristers’ rates to bring them in line with prosecution fees. It also puts forward other reductions to payments made for advocacy and litigation in the Crown court. The Society has so far declined to respond to the consultation, claiming that it is ‘not reasonably able to understand what the proposals are’. Bach was responding to a hard-hitting letter from Law Society president Robert Heslett, sent to the Ministry of Justice in early September. In that letter Heslett outlined what he described as a ‘host of inconsistencies’ in the consultation, including the lack of any explanation of the Government’s policy aims and what is meant by ‘oversubscription’ on police station schemes.In a detailed reply, Bach stresses that the MoJ is operating to a ‘strict budget’ and stresses that savings must be made in the criminal legal aid budget to protect funding for civil legal aid. The government’s proposals are targeted at ‘removing anomalies, disparities and duplication’ within the existing regime to generate savings, he adds. On football: Terrell Owens belongs in Canton

(Photo by Brian Bahr/Getty Images)When Pro Football Hall of Fame voters meet the day before the Super Bowl to choose the Class of 2018, the decision to select Terrell Owens should take less time than it does to microwave a bag of popcorn.T.O. belongs in Canton. It’s a no-brainer.Owens is second to Jerry Rice in all-time receiving yards and third in touchdown catches behind Rice and Randy Moss, a finalist in his first year of eligibility.No. 81 was a five-time All-Pro, a six-time Pro Bowl pick and one of the most entertaining players of his generation.Owens deserved first-ballot induction. Case closed. Yet, he’s been snubbed twice because voters are punishing him for his off-field and locker room “antics” during a sensational 15-year career.But there is no “character clause” for the Pro Football Hall of Fame _ and that’s not saying Owens should fail it.Owens was never arrested nor suspended by the NFL. He didn’t have legal issues or drug problems.Still, he’s been kept out because of questionable behavior and the perception he was a malcontent.Sure, Owens often spoke his mind and sometimes got under the skin of teammates and coaches. He threw some of his quarterbacks _ Jeff Garcia, Donovan McNabb and Tony Romo _ under a rapidly moving bus. He also defended Romo from criticism and famously cried once while doing it.Owens should be judged for his value on the field. He made every one of the five teams he played for better. He wasn’t the perfect teammate and he was disruptive at times, but when he stepped on the field, he was exceptional and durable.Owens only missed 12 games in his long career, plus the nine he didn’t play in 2005 after Andy Reid kicked him off the Philadelphia Eagles following a nasty feud with McNabb and a dispute with management over a new contract.That came only several months after Owens helped McNabb have his best season, and then heroically returned from ankle surgery _ against doctor’s orders _ to play in the Super Bowl. Owens would’ve been MVP of that game against the New England Patriots if McNabb didn’t throw three interceptions in the 24-21 loss.Anyone who covered the T.O. circus in Philadelphia and the aftermath knows Owens wasn’t solely to blame for the way things went down. McNabb was overly sensitive and didn’t like all the attention Owens received. McNabb was booed by Eagles fans at the 1999 draft and he never forgot it. The same fans embraced Owens from the second he arrived in Philadelphia after eight seasons in San Francisco. More than 20,000 people went to see his first practice of 2004 training camp at Lehigh University. That led to jealousy issues with McNabb that finally escalated a year later.After things got ugly in Philly, the locker room was divided between McNabb supporters and Owens supporters. If the mess was entirely Owens’ fault, some of the well-respected veterans who sided with him wouldn’t have done so.But it was easier for Reid to dismiss a 32-year-old receiver who wanted more money than a 28-year-old franchise quarterback who never ruffled any feathers.Owens ended up in Dallas and had three excellent seasons with the Cowboys before he wore out his welcome. He played one year in Buffalo and one more in Cincinnati.Those who argue that Owens bounced around the league because teams couldn’t wait to get rid of him should consider that Rice played for three clubs, and Hall of Fame receiver James Lofton also played for five. Lofton is on the 48-member selection committee and voted for Owens last year.This really shouldn’t be a difficult decision.
